TelyClaw Terms of Use (EULA)

1. AGREEMENT & JURISDICTION

1.1 Agreement: By using TelyClaw, you represent that you have the legal capacity to enter into this agreement. These terms apply to any updates or supplements to the App unless accompanied by separate terms.

1.2 Amendments: We may amend these terms at any time. Continued use of the App following any changes signifies your acceptance.

1.3 Jurisdiction: This EULA shall be governed by the laws of the jurisdiction where TelyClaw is registered, without regard to conflict of laws principles. Any legal action must commence within three (3) years after the cause of action accrues.

2. USER REQUIREMENTS

2.1 Age Requirement: You must be 13 years of age or older to use TelyClaw. If you are under 18, you must have your parent or legal guardian review and agree to this EULA on your behalf.

2.2 Registration: Certain features may require account registration. You are responsible for maintaining the confidentiality of your credentials and all activities under your account.

3. LICENSE AND USAGE RIGHTS

3.1 Grant of License: TelyClaw grants you a limited, non-exclusive, revocable, non-transferable license to use the App on a device you own or control for personal, non-commercial use.

3.2 Restrictions: You may not:

• Copy, modify, reverse-engineer, or create derivative works of the App.
• Use any automated system (robots, spiders) to interfere with the App's functionality.
• Rent, lease, or distribute the App to third parties.

3.3 Intellectual Property: All design, text, AI models (including OpenClaw infrastructure), logos, and code are the exclusive property of TelyClaw or its licensors.

4. APP FUNCTIONALITY & AI SERVICES

4.1 AI-Powered Features: TelyClaw provides AI summarization, smart replies, translation, and multimodal analysis. You acknowledge that AI-generated content is provided for informational purposes and may occasionally be inaccurate.

4.2 Third-Party Integrations: TelyClaw functions as an enhancement layer for messaging platforms like Telegram. We use the Telegram API but do not own or control the Telegram service. Your use is also subject to the terms of the respective messaging platform.

4.3 Content Ownership: You retain ownership of any content you submit through the App. However, by using our AI services, you grant TelyClaw a license to process this content solely to provide the requested AI functionality.

5. DATA COLLECTION & PRIVACY

5.1 Consent to Use of Data: You agree that we may collect technical and usage data to improve our services, as detailed in our Privacy Policy.

5.2 AI Privacy: We prioritize data integrity. Our use of Large Language Models (LLMs) is designed to handle data as transiently as possible. We do not use your private message content to train public AI models without your explicit consent.

6. PURCHASES AND SUBSCRIPTIONS

6.1 Premium Services: TelyClaw may offer "Premium" subscription plans. Payments are processed via third-party platform owners (Apple App Store, Google Play).

6.2 Cancellation & Refunds:

• App Store/Google Play: Refunds and cancellations are governed by the respective store's policies.
• Direct Purchase: If applicable, by downloading digital content, you acknowledge that you waive your right to a refund once the delivery has commenced.

6.3 Auto-Renewal: Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.

7. PROHIBITED CONDUCT (OBJECTIONABLE CONTENT)

TelyClaw maintains a Zero-Tolerance Policy regarding:

• Unlawful, harmful, or predatory content.
• Content that infringes on the intellectual property of others.
• Child Sexual Abuse Material (CSAM).
• Spam, viruses, or malicious code.

We reserve the right to terminate access immediately for any user who violates these standards.

8. DISCLAIMERS & LIMITATION OF LIABILITY

8.1 "As-Is" Basis: The App is provided "As-Is" without warranties of any kind. We do not guarantee that AI features will be 100% accurate or that the service will be uninterrupted.

8.2 Limitation of Liability: To the maximum extent permitted by law, TelyClaw shall not be liable for any indirect, incidental, or consequential damages arising from your use of the App. Our total liability shall not exceed the amount paid by you for the App in the past 12 months.

9. TERMINATION

Your rights under this EULA will terminate automatically if you fail to comply with any terms. Upon termination, you must cease all use of the App and delete all copies.
